1. Overview
Welcome to NELO. These Terms of Service (“Terms”) govern your use of nelowear.com (the “Site”) and any purchase you make with us. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. About Nelo
NELO is operated by Nelo Group Inc., a North American company based in Mississauga, Ontario and New York.

3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on our Site. By using the Site and placing an order, you confirm that you meet this requirement.

4. Products and pricing
Product availability: All products are subject to availability. We reserve the right to limit quantities on any item, including pre-order and limited-run pieces.
Prices: Prices are displayed in the currency shown on the Site or at checkout and may change without notice. The price applicable to your purchase will be the price shown when you complete checkout, subject to corrections for genuine pricing or technical errors where permitted by law.
Product representation: We make reasonable efforts to display product colours, measurements, materials, images, and other details accurately. Slight variations may occur because of screen settings, photography, lighting, manufacturing tolerances, or other factors.

5. Orders and payment
Order acceptance: By placing an order, you are making an offer to purchase the products in your order. We may accept or decline an order where permitted by law, including in cases involving suspected fraud, payment issues, pricing errors, stock discrepancies, or other legitimate operational concerns.
Payment: Payment is processed securely at checkout using the payment methods available to you at the time of purchase. Pre-order products may be subject to additional timing and payment terms disclosed on the applicable product page or in our Pre-Order Policy.

Order cancellation and changes: Once an order has been placed, it cannot be cancelled or modified by the customer. This includes changes to items, sizes, colours, quantities, or shipping details. We may cancel or refuse an order where permitted by applicable law. If an order is cancelled by us after payment has been collected, any refund due will be returned using the applicable payment method.

6. Shipping and delivery
Shipping timelines, delivery estimates, tracking information, and related terms are outlined in our Shipping Policy. Delivery estimates are not guaranteed and may be affected by carrier delays, weather, customs, holidays, or other factors outside our reasonable control.

7. Returns and refunds
Eligible purchases may be returned within 30 days of the shipping date, which is the date shown on your shipping confirmation email, in accordance with the return requirements, exclusions, and refund procedures described in our Returns & Refunds policy. Items must be unworn, unwashed, undamaged, and unaltered, with original tags attached and in their original packaging. The customer is responsible for the cost of return shipping. Final sale and clearance items cannot be returned or exchanged. Pre-order items follow our Pre-Order Policy at nelowear.com/pages/pre-order, including refunds as store credit only. By making a purchase, you agree to the applicable return and refund terms, subject to any rights provided to you by law.

8. Intellectual property
Content created or owned by Nelo on this Site, including Nelo logos, branding, original designs, product photography, graphics, and text, is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, publish, commercially exploit, or otherwise use Nelo-owned content without appropriate authorization.

9. User conduct
You agree not to:
Use the Site for any unlawful purpose.
Attempt to gain unauthorized access to systems, accounts, or data.
Interfere with the security, operation, or functionality of the Site.
Submit false, fraudulent, or misleading information when placing an order or communicating with us.
Use automated systems in a manner that materially disrupts the Site or its services.

10. Third-party links and services
Our Site may contain links to third-party websites or use third-party services such as ecommerce infrastructure, analytics providers, payment providers, shipping carriers, and other service providers. Third-party services may be governed by their own terms, policies, and practices. To the extent permitted by law, Nelo is not responsible for independently operated third-party websites or services that we do not control.

11. Limitation of liability
To the fullest extent permitted by applicable law, Nelo will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or products purchased through it. To the fullest extent permitted by law, Nelo’s aggregate liability relating to a particular purchase will not exceed the amount paid for the applicable order. Nothing in these Terms excludes, restricts, or limits liability or consumer rights that cannot lawfully be excluded, restricted, or limited.

12. Disclaimer of warranties
Except for warranties or protections that cannot be excluded under applicable law, the Site and products are provided subject to the terms and information made available at the time of purchase. Nothing in these Terms is intended to waive any mandatory warranty, remedy, or consumer-protection right available to you under applicable law.

13. Governing law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. This provision does not deprive you of any mandatory consumer rights or protections that apply to you under applicable law.

14. Changes to these Terms
We may update these Terms from time to time to reflect changes to our business, services, legal obligations, or practices. The updated version will be posted with a revised “Last updated” date. Your continued use of the Site after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
